Scaling.com Affiliate Program – Terms & Conditions

1. Introduction
These Terms and Conditions (“Terms”) govern your participation in the Scaling.com Affiliate Program (“Program”). By joining or participating in the Program, you agree to these Terms.
2. Eligibility
- Must be at least 18 years old.
- Must provide accurate registration information.
- Marketing activities must be lawful, non-deceptive, and compliant.
3. Affiliate Responsibilities
- Promote Scaling.com honestly.
- Avoid spam or misleading advertising.
- Do not misrepresent your relationship with Scaling.com.
- Must comply with FTC disclosure rules.
FTC Disclosure Requirements:
Affiliates must clearly disclose that they may receive compensation from Scaling.com for referrals. Examples:
“I may receive compensation if you purchase through my link.”
“As a Scaling.com affiliate, I may earn from qualified referrals.”
Disclosures must be clear, close to the link, and easy to understand.
4. Affiliate Links
Only referrals tracked through the official affiliate system qualify.
5. Qualified Referrals
A referral must:
1. Run a company doing at least $500,000 yearly revenue.
2. Be the primary decision-maker.
3. Be committed to 10x’ing the company in 3 years or less.
4. Stay in the program at least 30 days.
6. Commissions
Paid:
- Within 60 days of referral beginning the program AND
- No earlier than 30 days after the referral’s first payment.
7. Tier Rewards
Tier 1 – 1 Qualified Referral
- $2,000 cash
- Access to Dr. Benjamin Hardy’s Vault (full courses list)
Tier 2 – 3 Qualified Referrals
- $4,000 cash
- Vault access
- Signed copies of all 10 Hardy books
- Access to Scaling.com core content
- Virtual half-day workshop
Tier 3 – 5 Qualified Referrals
- $4,000 cash
- Vault access + signed books + core content
- Virtual workshop
- Invitation for 1 to Dr. Hardy’s home (meals included)
- Affiliate responsible for travel and lodging.
Tier 4 – 10 Qualified Referrals
- $20,000 cash
- Vault access + books + core content
- Virtual workshop
- Invitation to Dr. Hardy’s home (meals included)
- Affiliate responsible for travel and lodging.
- Invitation for 3 guests (meals included)
- Guests responsible for travel and lodging.
Tier 5 – 25 Qualified Referrals
- $30,000 cash
- Vault access + books + core content
- Virtual workshop
- Mastermind invitation (meals included)
- Affiliate responsible for travel and lodging.
- Invitation for 3 guests (meals included)
- Guests responsible for travel and lodging.
- Final bonus: $50,000 cash OR 2-year luxury vehicle lease (up to $50,000)
Total max value: $110,000
8. Taxes
Affiliates are responsible for all applicable taxes on cash and non-cash rewards.
9. Prohibited Activities
- Misleading advertising
- Unauthorized claims
- Cookie stuffing
- Unauthorized discounts
- Using own affiliate link
10. Intellectual Property
Limited license for approved branding. No misuse permitted.
11. Indemnification
Affiliate agrees to indemnify Scaling.com for:
- Misleading advertising
- Unauthorized claims
- Violations of law
- Violations of these Terms
12. Termination
Scaling.com may suspend or terminate at any time.
13. Modification of Terms
Scaling.com may update Terms at any time.
14. Limitation of Liability
Scaling.com not liable for indirect or incidental damages except where prohibited by law.
15. Independent Contractor
Affiliate acts as an independent contractor and is responsible for their own taxes and expenses.
16. Governing Law
Governing law is Scaling.com's operating jurisdiction, to the maximum extent allowed under California law.
17. Contact
California Addendum:
1. Must comply with FTC and California disclosure rules.
2. Affiliate operates independently and uses their own tools.
3. California residents retain non-waivable rights.
4. California residents responsible for state taxes.
